01About these terms

These Terms of Service govern your use of the Sweps Studio website (the “Site”), operated by SWEPS INC (“Sweps”, “we”, or “us”). Please read them before using the Site. If you do not agree with these terms, please do not use the Site.

The Site presents our design services, selected work, and ways to contact us. These website terms do not replace a separate written agreement for client work.

02Enquiries and project agreements

Sending a message, selecting a package, or discussing an idea does not by itself create a client engagement, reserve availability, or commit either party to a project.

Before a project begins, the parties agree its scope and commercial terms separately. Those terms address the deliverables, price, payment schedule, timing, feedback rounds, cancellation arrangements, and rights in the final work. If a project agreement conflicts with these terms on a matter concerning that project, the project agreement controls.

Package descriptions are starting points. Portfolio delivery times describe those projects and are not a promise of the timing or results of a future engagement. Final timelines depend on the agreed scope, content, feedback, and availability.

03Acceptable use

You may browse the Site and contact us for legitimate purposes. You must not:

• Use the Site for unlawful, fraudulent, or abusive activity.
• Send spam, malware, misleading enquiries, or content that infringes another person’s rights.
• Try to gain unauthorised access, bypass security controls, or disrupt the Site or its providers.
• Use automated requests in a way that unreasonably burdens the Site or interferes with other visitors.

We may restrict access or decline to respond where reasonably necessary to address misuse or protect the Site.

04Website content and intellectual property

The Site’s design, text, graphics, and other materials belong to SWEPS INC or their respective owners and are protected by applicable intellectual-property laws. Client names, trademarks, and portfolio materials remain subject to their owners’ rights.

You may view the Site for information and to evaluate our services. Except where permitted by law or by the rights holder, you may not reproduce, distribute, sell, or present Site content as your own. Displaying a project does not grant you rights to its code, brand, or other materials.

Ownership and licences for work created for a client are determined by the applicable project agreement.

05Information and materials you send

Please provide accurate contact information and only send material you are entitled to share. Do not send passwords, payment details, or sensitive personal information through the contact form.

You retain your rights in materials you submit. Sending them allows us to review them and communicate with you about the enquiry; it does not transfer ownership to us. Any additional use, confidentiality commitments, or project rights should be set out in a separate agreement.

06Third-party websites and services

The Site links to project websites, X, and other third-party resources. Those websites and services are controlled by their own operators and have their own terms and privacy practices. We are not responsible for their availability or content.

Our contact form uses FormSubmit to deliver messages. Information about this and other service providers is available in our Privacy Policy.

07Information and availability

We aim to keep the Site accurate and useful, but content may be updated, incomplete, or unavailable from time to time. We may change or discontinue parts of the Site. Descriptions of services are general information and do not guarantee a particular commercial outcome.

To the extent permitted by applicable law, the Site is provided on an “as available” basis without warranties that it will always be uninterrupted, error-free, or suitable for every purpose. This does not alter any express obligations in a project agreement.

08Responsibility and legal rights

To the extent permitted by applicable law, SWEPS INC is not responsible for indirect or consequential losses arising solely from use of, or inability to use, this informational Site.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, or removes any mandatory consumer rights. Liability for paid services is addressed in the applicable project agreement, subject to those rights.

09Changes to these terms

We may revise these terms to reflect changes to the Site or applicable requirements. The updated version will be posted on this page with a revised date. Changes apply to use of the Site after they take effect and do not amend an existing project agreement unless the parties agree otherwise.

If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
